Terms of Service
Spark is a local-first AI agent tool. Use it lawfully, review what it does, and keep control of the providers and systems you connect. These terms cover the website, installer, open-source runtime, and any Sparkswarm-hosted services.
1. What Spark is
Spark is a local-first personal AI agent runtime. You install it on your machine. It uses providers and tools you choose, such as Telegram, GitHub, Codex, Claude Code, local models, or API-key LLM providers. Local agent output, memory, missions, and tools live on your device unless you route them somewhere else.
2. License
Spark code and related open formats are distributed under the license files in their source repositories. Those repository licenses control your rights to install, modify, and redistribute the open-source parts. Paid or hosted features may have additional terms when they become available.
3. Your account
Most local Spark features do not require a Sparkswarm account. If you use a hosted, paid, or swarm feature later, you are responsible for keeping account credentials secure. We may limit or suspend hosted access that violates these terms or creates risk for other users.
4. Acceptable use
You agree not to use Spark to:
- Violate any applicable law.
- Infringe someone else's intellectual property.
- Send spam, phishing, malware, or fraudulent communications.
- Attack systems you are not authorized to access.
- Generate content that sexualizes minors or incites violence against individuals or groups.
Spark's recursive training loops are a tool. You are responsible for what you ask Spark to automate, what systems you connect, and what you ship from its output.
5. Third-party services
Spark can connect to third-party services through OAuth, API keys, command-line tools, local servers, or provider accounts. Those services have their own terms, privacy policies, and billing. Using Spark does not change your obligations to them.
6. Output review
AI output can be wrong, incomplete, insecure, or inappropriate for your use case. You are responsible for reviewing Spark's work before relying on it, shipping it, sending it, spending money from it, or giving it access to sensitive systems.
7. No warranty
Spark, the website, installer, documentation, and hosted features are provided as is and as available. We do not promise that Spark will be uninterrupted, error-free, secure for every environment, or suitable for every purpose.
8. Limitation of liability
To the maximum extent permitted by law, Sparkswarm is not liable for indirect, incidental, consequential, or punitive damages arising from use of Spark. Our total liability for direct damages will not exceed the amount you paid us in the twelve months before the event giving rise to the claim, or $100, whichever is greater.
9. Changes to Spark
We may update Spark, change premium features, or retire parts of the stack. For breaking changes to paid features, we will give reasonable notice. The open-source runtime you installed stays yours on whatever version you already have.
10. Changes to these terms
If these terms change materially, the date at the top will change. Continued use of Sparkswarm-hosted features after an update means you accept the updated terms.
11. Contact
Legal questions: [email protected]. Abuse reports: [email protected].
These terms are written to be understandable. If a repository license or signed agreement gives you different rights, that specific document controls for that scope.
